Information We Collect

We only collect personal information that is necessary for providing and improving our Service. The types of data we may collect include:

Account Information: When you or your organization registers an account, we collect information like your name, work email address, password (stored in hashed form for security), company/organization name, and role (e.g. admin or employee user). We use this to create and secure your account and to identify you within the app.

Communication Plan Content: Broadcast Maestro allows you to input data to create communication plans (such as project goals, target audience details, budgets, and related notes). All content you enter into your communication plans is stored in our system. Note: This content may include business information or personal data (if, for example, you include names or contact details of team members or stakeholders in a plan). You should ensure you have the right to include any personal data in the plans. You retain ownership of the content you create; we will only use it to operate the Service as described in this Policy (see How We Use Your Information below).

Usage Data: We collect information about how you use Broadcast Maestro. This includes your interactions with the app (e.g. features used, pages viewed, the time spent on pages, clicks, and other actions). We also log technical data such as your Internet Protocol (IP) address, browser type, device type (e.g. laptop or smartphone), operating system, and unique device identifiers. This data helps us understand usage patterns and improve our Service. Wherever possible, we aggregate or anonymize usage data so it does not directly identify you.

Cookies and Similar Technologies: When you use our website, we use cookies and similar tracking technologies to recognize your browser or device. For example, we use essential cookies to remember your login session (so you don’t have to sign in repeatedly) and to enable core functionality of the site . How We Use Your Information

We use the collected information for the following purposes:

Providing and Improving the Service: We process your personal data to operate Broadcast Maestro’s core functionalities. This includes using your Account Information to authenticate you and personalize your experience, and using your Communication Plan Content to generate the plans and recommendations you request. For example, the app may use your input (goals, audience, budget) to suggest a structured communication plan tailored to your needs. We also use Usage Data (such as feature usage and feedback) to understand how our Service is performing and to identify areas for improvement or new features.

Account Administration and User Support: If you are an admin user, we use your information to help you manage your organization’s account (e.g. to allow you to invite employees or adjust settings). For all users, we use contact information to send important administrative communications. These include service-related emails like confirmations, password reset emails, updates about significant changes to the Service or this Policy, and responses to support requests. We may also send optional communications (such as newsletters or product updates) but only if you have opted in to receive them. You can unsubscribe from optional communications at any time.

Analytics and Performance: With the help of cookies and third-party analytics tools, we analyze how users interact with Broadcast Maestro in order to troubleshoot issues and make data-driven improvements. For instance, we might track how often certain features are used or how users navigate through the app’s interface . This helps us optimize the user experience and prioritize new features. Wherever feasible, we use aggregated or anonymized data for analytics to avoid unnecessary identification of individuals.

Security and Abuse Prevention: We are dedicated to keeping Broadcast Maestro secure. For example, we may retain certain transaction records for accounting and tax purposes, or disclose information if required by law (such as complying with a court order or valid law enforcement request). Legal Basis for Processing

Performance of a Contract: Most of our data processing is justified by the fact that it is necessary to provide the Service that you or your employer have requested. When you use Broadcast Maestro, you enter into an agreement (the Terms of Service) with us, and we need to process your data to fulfill our obligations under that contract . For example, we require your login credentials to authenticate you and your input data to generate a communication plan. We cannot provide the Service without this information.

Legitimate Interests: In some cases, we process data to pursue our legitimate business interests, and we do so in a way that does not override your privacy rights. These legitimate interests include improving and securing our Service, communicating with you about product updates or offers (for existing customers), and analyzing usage to make informed business decisions . For instance, it’s in our interest (and yours) to ensure our app is reliable and user- friendly, so we might process Usage Data to debug and enhance Broadcast Maestro’s performance. When relying on legitimate interests, we consider and balance any potential impact on your rights and will honor your objections in appropriate cases (see Your Rights below).

Consent: We will ask for your consent to process your data in certain situations when we are required to do so. If you grant consent, you have the right to withdraw it at any time. For instance, you can opt out of marketing emails by clicking the “unsubscribe” link, or adjust your cookie preferences via our cookie banner or your browser. Withdrawing consent will not affect the lawfulness of processing already carried out, but it will stop the specific activity going forward.

Legal Obligation: We may process and retain some personal data to comply with laws and regulations. For example, financial transaction records might be kept to satisfy Dutch tax law requirements, or we may need to verify your identity to meet anti-fraud or anti-money laundering rules. When we process data for legal compliance, this is mandated by applicable law (e.g. EU or member state law) and we will only do so to the extent required.

Other Bases: In very rare cases, we might process personal data to protect vital interests (i.e. life-and-death situations) or to perform a task in the public interest, but Broadcast Maestro’s typical operations do not involve these scenarios. If they ever do arise, we will only proceed in accordance with GDPR Articles 6(d) and 6(e) and inform you as required.

How We Share Your Information

We treat your personal data with care and confidentiality. We do not share or disclose your information to third parties except in the following circumstances:

Within Your Organization: If your Broadcast Maestro account is provided by a large organization (e.g. your employer), certain data may be shared within that organization. Specifically, designated administrators (“admins”) of your organization can access information in the company’s Broadcast Maestro workspace. For example, admins may see the communication plans created by employees in their team, manage user accounts (adding or removing employee access), and view usage reports for their organization. This is inherent to how Broadcast Maestro works in an enterprise setting – it allows collaboration and oversight within your company. If you are an employee user, please be aware that your organization’s admin(s) can view and manage data you store in Broadcast Maestro (consistent with the app’s features).

Service Providers (Processors): We employ trusted third-party companies to help us operate and improve Broadcast Maestro. These service providers process personal data on our behalf under strict instructions (they are known as “processors” under GDPR) . Examples include cloud hosting providers (to store data and run our application), email delivery services (to send verification or notification emails), analytics services, and customer support tools. We only share the minimum data necessary for each provider to perform their function, and they are contractually obligated to keep your data secure and use it solely for providing services to us. We ensure any international data transfers via these providers are safeguarded (see International Data Transfers below). A list of key sub-processors can be provided upon request.

Legal Compliance and Protection: We may disclose your information if we are legally required to do so or if we need to protect our rights or the rights of others. For example, we might release information in response to a court order, subpoena, or other lawful government request. Rest assured, we carefully review such requests and will only comply if required by applicable law.

Business Transfers: If Broadcast Maestro undergoes a business transition, such as a merger, acquisition by another company, or sale of all or part of its assets, your personal data may be transferred to the successor entity as part of that transaction. If such a transfer occurs, we will ensure that your data remains subject to equivalent privacy protections as under this Policy, and we will notify you (for example, via email or a prominent notice on our site) of any change in data ownership. You will also be informed of any choices you may have regarding your information in such an event.

With Your Consent: Apart from the cases above, we will only share your personal data with third parties when you have given us explicit permission to do so. For instance, if in the future Broadcast Maestro offers an integration with another service, we would only share your data with that service when you opt-in or instruct us to (and we would explain what data would be shared and why).

No Unauthorized Third-Party Sharing: We do not sell, rent, or exchange your personal information with marketers or other unrelated third parties for their own purposes. All third parties who process your data are serving Broadcast Maestro’s purposes as explained here, or are involved due to your role within an organization using Broadcast Maestro. We remain accountable for the protection of your information when it is under our control or oversight.

For information on how we use cookies and similar tracking technologies, please refer to our Cookie Policy (provided as a separate document). In short, when you visit our website, we will only set non-essential cookies (such as analytics cookies) on your device if you agree via our cookie consent banner . Essential cookies that are necessary for our site to function (for example, to keep you logged in or to remember items in a form you are filling out) do not require prior consent, but we still inform you about them and why they are needed . Our Cookie Policy details the types of cookies we use, their purpose, and how you can manage your preferences at any time. You can also control cookies through your browser settings (for example, most web browsers allow you to block or delete cookies) .

Data Retention

We will retain your personal data only for as long as it is necessary to fulfill the purposes described in this Policy, unless a longer retention period is required or permitted by law. In practice:

Account Data: If you have an account with Broadcast Maestro, we keep your personal profile information and any Communication Plan Content you have created for as long as your account is active. This allows us to provide you with continuous access to your saved plans and settings. If you or your organization chooses to delete your account, or if you request deletion of specific personal data, we will remove or anonymize that information from our active databases. This process is usually completed within a short period (typically within 30 days of confirmation of deletion request), barring unforeseen technical delays.

Organizational Accounts: If your organization’s subscription to Broadcast Maestro ends or is terminated, we will typically delete or anonymize the personal data associated with that organization’s users after a defined retention period. In some cases, upon an organization admin’s request, we may provide a limited window for data export before deletion.

Usage Logs: Aggregated usage data (which does not directly identify individuals) may be retained longer for analytical purposes. However, any usage logs that contain personal data (like IP addresses) are generally kept only for a short duration – for example, logs may be kept for security auditing and debugging for a few weeks or months, and then either deleted or stripped of personal identifiers.

Legal Requirements: We may retain certain information for longer if required by applicable laws. For instance, financial records (invoices, payment transactions) are generally retained for the period required under tax and accounting laws. Similarly, if we are handling a legal dispute or investigation, we will retain the relevant information until that issue is resolved, even if that extends beyond our normal retention schedule.

Backups: Please note that when we delete data from our active systems, it might still exist in our securely encrypted backups for a period of time until those backups are cycled out. We maintain backups to ensure we can recover data in case of system failures or disasters. We have processes to eventually purge or overwrite old backup data, so your deleted data will be removed from backups in due course as well.

After the retention period expires or when data is no longer needed, we either securely delete it or irreversibly anonymize it so that it can no longer be associated with you. If deletion or anonymization is not immediately possible (for example, if the data is stored in archival systems), we will ensure it is isolated and protected from further use until deletion is feasible.

Your Rights Under GDPR

If you are in the European Union or otherwise subject to GDPR, you have several important rights regarding your personal data (data subject rights) . Broadcast Maestro respects and upholds these rights. In summary, you have the right to:

Right to be Informed: You have the right to clear and transparent information about how we collect and use your personal data. We fulfill this through notices like this Privacy Policy (and any specific notices we provide when you sign up or use certain features)

Right of Access: You can request a copy of the personal data we hold about you . We will provide you with a summary of this information, along with an explanation of why we have it and how we use it, within the legally required timeframe. For example, you can ask us, “What information do you have about me in your systems?” and we will supply it, usually free of charge (unless the requests are excessive or repetitive as defined by law).

Right to Rectification: If any of your personal data is inaccurate or incomplete, you have the right to have it corrected . You can update some information directly in your account profile (e.g. you may update your name or email if it changes). For other data or if you need assistance, you can contact us and we will rectify any inaccuracies promptly.

Right to Erasure (Right to be Forgotten): You may request that we delete your personal data . If you decide you no longer want to use Broadcast Maestro, you can delete your account through the account settings, or ask us to delete it for you. We will then erase your personal data, provided we do not have a valid legal reason to retain it (for example, we might retain certain records to comply with legal obligations – we will inform you if so). We will also take reasonable steps to inform any third-party processors that your data should be deleted from their systems as well.

Right to Restrict Processing: In certain situations, you have the right to ask us to restrict or “pause” the processing of your data . For instance, if you contest the accuracy of data, or we are handling an objection to our processing (see “Right to Object” below), you can request a temporary restriction. During the restriction period, we will store your data securely and only process it with your consent or for legal reasons.

Right to Data Portability: You have the right to obtain your personal data in a common, machine-readable format and to have that data transferred to another controller where technically feasible . In practice, this means you can ask for an export of the data you provided to us (and which we process by automated means, under either consent or contract basis). If you need such an export, we will provide your data in a structured format (for example, a CSV or JSON file) that you could import into another service. (As an example, if you ever wanted to move your communication plans data out of Broadcast Maestro to another tool, this right would facilitate that).

Right to Object: You have the right to object to our processing of your personal data in certain circumstances . Notably, you can object at any time to processing of your data for direct marketing purposes, and we will honor that (we already ensure we only send marketing with consent). You can also object if you believe our legitimate interests processing (see Legal Basis above) infringe on your rights. If you object, we will review your request and unless we have a compelling legitimate ground that overrides your objection or we need to continue processing for legal claims, we will cease the processing in question.

Rights Related to Automated Decision-Making: The GDPR provides you the right not to be subject to a decision based solely on automated processing, including profiling, if it produces legal effects or similarly significant effects on you . In plain English, this means if we ever use algorithms to make important decisions about you without human involvement, you have the right to: (a) be informed that we’re doing so, and (b) object or request human review of those decisions. Important: Broadcast Maestro does not currently make any solely-automated decisions with legal or significant effects on individuals. The suggestions or plan outputs Broadcast Maestro generates are interactive and under your control (they guide you in planning communications, but do not make decisions about you). If this ever changes, we will update this Policy and ensure compliance with GDPR’s provisions on automated decision-making.

To exercise any of your rights, please contact us at our privacy contact (see Contact Us below). We may need to verify your identity before fulfilling certain requests (to ensure we don’t disclose your data to someone else). We will respond to your request as soon as possible, and in any event within one month, as required by GDPR. There is no fee for exercising your rights unless the requests are manifestly unfounded or excessive, in which case (according to GDPR) we may charge a reasonable fee or refuse the request with explanation.

Additionally, you have the right to lodge a complaint with a supervisory authority if you believe our processing of your personal data violates the law. In the Netherlands, the supervisory authority is the Autoriteit Persoonsgegevens (AP), which is the Dutch Data Protection Authority . If you reside in another country, you may contact your local data protection authority. Of course, we would appreciate the chance to address your concerns directly first, and will do our best to resolve any issues.

Security

We take data security seriously and have implemented appropriate technical and organizational measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. These measures include, for example, encryption of data in transit (SSL/TLS) and at rest where applicable, firewalls and network security controls, regular software updates and security patches, and access controls to limit which of our employees or contractors can access personal data. We also train our team about the importance of privacy and security.

While we strive to protect your information, it’s important to note that no method of transmission over the internet or method of electronic storage is 100% secure. We thus cannot guarantee absolute security of your data . For instance, despite our safeguards, there is always some risk that an unauthorized third party could find a way to thwart our security measures. You play a role in keeping your data secure as well: please maintain the confidentiality of your account password and notify us immediately if you suspect any unauthorized access to your account. We have procedures in place to deal with any suspected data breaches, and if required by law, we will notify you and the relevant authorities of any breach affecting your personal data.

International Data Transfers

Broadcast Maestro is based in the Netherlands, and generally we aim to store and process personal data within the European Economic Area (EEA) to take advantage of GDPR’s robust protections. However, some of our service providers may be located outside of the Netherlands or the EEA. If we need to transfer your personal data to a country outside the EEA (for example, if we use a cloud hosting provider or an analytics service based in the United States), we will do so in compliance with GDPR Chapter V (which governs international transfers). This means we will ensure appropriate safeguards are in place to protect your data during the transfer, such as using the European Commission’s Standard Contractual Clauses (SCCs) with the recipient, or relying on an adequacy decision (if the country is deemed by the EU to have adequate data protection laws). We will also evaluate, on a case-by-case basis, whether additional technical or contractual measures are needed to meet EU standards of protection.

By using Broadcast Maestro, you understand that your personal information may be transferred to our servers and authorized third parties in various countries around the world. Regardless of where your data is processed, we will take steps to ensure that your privacy continues to be protected as outlined in this Policy. Children’s Privacy

Broadcast Maestro is not directed to individuals under the age of 16. We do not knowingly collect personal data from children under 16 years old. If you are under 16 (or the equivalent minimum age in your jurisdiction to provide consent for data processing), please do not use Broadcast Maestro or provide any personal information to us without verifiable parental consent. Parents or legal guardians should supervise their children’s internet usage and can contact us to request deletion of any personal data accidentally collected from a minor. If we become aware that we have unknowingly collected personal information from a child under 16 without proper consent, we will take prompt steps to delete it. This may include deleting the child’s account and any content associated with it, as well as notifying the parent or guardian if possible. If you believe that we might have any information from or about a child under 16, please inform us immediately so that we can take appropriate action.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or for other operational reasons. When we make changes, we will revise the “Last updated” date at the top of this Policy. Acceptance of Terms: Welcome to Broadcast Maestro! These Terms of Service (“Terms”) govern your access to and use of the Broadcast Maestro website and application (collectively, the “Service”). By using the Service, you agree to be bound by these Terms, along with our Privacy Policy and Cookie Policy (which are hereby incorporated by reference) . If you do not agree with these Terms or our other policies, you must not use Broadcast Maestro. These Terms form a binding legal agreement between you (the user) and Broadcast Maestro (the provider of the Service, referred to as “we”, “us”, or “our”). We recommend that you read these Terms carefully to understand your rights and obligations. If you have any questions, please contact us before using the Service.

Eligibility: You must be at least 16 years old (or the minimum legal age in your country to form a binding contract, if higher) to use Broadcast Maestro . The Service is intended for adult professionals – specifically, employees of organizations – to create communication plans. By registering or using Broadcast Maestro, you represent and warrant that you meet the applicable age requirement. If you are under the legal age in your jurisdiction, you may only use Broadcast Maestro under the supervision and with the consent of a parent or legal guardian. It is ultimately the responsibility of your organization (if you are using Broadcast Maestro through an employer or institution) to ensure that users meet these age requirements. We reserve the right to ask for proof of age or permission at any time, and to terminate accounts that do not fulfill these criteria.

User Accounts and Registration: In order to access most features of Broadcast Maestro, you (or your organization’s administrator) need to create an account. When registering, you agree to provide true, accurate, and current information about yourself (such as your name and a valid email address) . You also agree to keep this information up-to-date. For example, if your email address changes or you transfer to a different department in your company, please update your account details so we have correct information. You are responsible for maintaining the confidentiality of your account login credentials. Do not share your password or allow others to use your account. If you suspect any unauthorized access to your account, you must notify us immediately. We implement reasonable security measures to protect accounts, but we cannot guarantee that unauthorized parties will never be able to defeat those measures . Therefore, you should also use a strong, unique password and exercise caution on any shared or public devices.

Broadcast Maestro may allow single sign-on or registration via third-party identity providers (like signing in with Google or Microsoft). If you choose to register or log in through a third-party service, you authorize Broadcast Maestro to access and use certain account information from that service (e.g. your email and name) as permitted by that provider and by our Privacy Policy . Using a third-party login does not waive any of your obligations under these Terms – you are still fully responsible for actions taken under your Broadcast Maestro account.

User Roles (Administrators and Employees): Broadcast Maestro is designed for use by large organizations and their teams. There are typically two types of user roles on the platform:

Admin Users: An admin is usually a representative of an organization (for example, a team leader or IT administrator) who has special permissions to manage the organization’s workspace on Broadcast Maestro. Admins can create the organization’s account, invite or remove employee users, assign roles, and access all communication plans and data created under their organization’s account. If you are an Admin, you agree to use these powers responsibly. This means you should only invite users who are part of your organization or otherwise authorized, and you must ensure that all employee users are aware of and comply with these Terms. Admins are responsible for managing their organization’s subscription, if applicable (such as keeping billing information up to date), and ensuring that users who leave the organization or no longer require access have their access revoked in a timely manner. For example, if an employee leaves your company, the admin should deactivate or delete that user’s account to maintain security.

Employee Users: An employee user is typically an individual who has been invited by an admin to join their organization’s Broadcast Maestro workspace, or who has registered using a company email domain associated with an organization on Broadcast Maestro. If you are an Employee User, your access to the Service is provided courtesy of your employer or organization. You will have the ability to create and manage communication plans for your projects, collaborate with colleagues if the app supports it, and use other features as enabled by your admin. Keep in mind that your organization’s admin can likely see your activity and content within Broadcast Maestro (they have oversight of all plans made under the company account). You are expected to use the Service for legitimate business purposes in line with your organization’s policies and these Terms. If your employment or association with the organization ends, you should stop using the organization’s Broadcast Maestro account, and the admin may terminate your access.

Account Responsibility:

Whether you are an admin or an employee user, you are responsible for all activities that occur under your account. Please use the Service only for its intended purpose of creating and managing communication plans within your organization. You agree not to impersonate someone else or misrepresent your identity or affiliation with any person or entity. If you become aware of any unauthorized use of your account or any security breach, you must promptly notify Broadcast Maestro support. We are not liable for any loss or damage arising from your failure to comply with the above account security obligations.

User Content and Intellectual Property: Broadcast Maestro allows you to input and store content – specifically, the details of your communication plans (such as written strategies, target audience descriptions, budgets, timelines, and any file attachments you choose to upload). For the purposes of these Terms, we’ll refer to all of this material as “User Content.”

Your Ownership: You retain all rights and ownership in the User Content that you create or upload to Broadcast Maestro . In other words, the communication plans, strategies, and data you put into the app remain yours (or your organization’s). We do not claim ownership over your plan content. For example, if you draft a communication plan for a product launch using Broadcast Maestro, you (or your company) own that plan and all the information in it.

Our License to Use Content: In order to operate and provide the Service, we require certain limited rights to your User Content. By using Broadcast Maestro and submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, host, copy, and process your content solely for the purposes of operating, maintaining, and improving the Service. This means we will not use your content outside of providing the service to you. We will never sell your User Content or use it for marketing without your permission. The license is only so that our systems can save your work, back it up, transmit it to you and those you share it with, and index it for features like search within your plans. This license is necessary for the Service to function – for example, our servers need to temporarily store your data and our application might process it (like analyzing inputs to format a plan). We do not publicly display or publish your content to others outside your organization unless you explicitly direct us to (for instance, if a future feature allows you to share a plan via link, it would be your choice to generate such a link). If you delete your content or your account, our license to use that content for providing the Service will end after the deletion is processed (except for any residual backups as described in the Privacy Policy).

Your Content Responsibilities: You are solely responsible for the User Content you create or upload on Broadcast Maestro. This means (i) you should only include content that you have the right to use, and (ii) your content must not violate any laws, these Terms, or any third-party rights. In particular, do not upload any content that is defamatory, obscene, harassing, infringing (for example, do not include copyrighted material that you do not have permission to use), or that contains others’ personal data without authorization. If your communication plan includes personal data about individuals (like names or contact details of people in a target audience), make sure your use of that data is compliant with privacy laws and that you have any necessary permissions. You agree that we are not responsible for any violations on your part, and you will indemnify us (reimburse us for any losses) if a third party brings a claim against us due to your unlawful or infringing content (see Indemnification below for details).

Review and Removal of Content: We do not pre-screen User Content as a matter of course, and the content you create is generally private to you and your organization. However, we reserve the right (but do not have the obligation) to review and remove any User Content that we believe, in our discretion, violates these Terms or applicable law. For example, if we become aware that someone is using Broadcast Maestro to store illicit content or malicious code, we may disable or delete such content and take appropriate action on the account. We may also disclose content to authorities if required by law (per our Privacy Policy). We will typically attempt to notify the affected user in such cases, unless we are legally prevented from doing so or if the situation is urgent or could harm other users or the Service.

Broadcast Maestro’s Intellectual Property: Apart from User Content, all materials and software that make up the Service are owned by or licensed to Broadcast Maestro and are protected by intellectual property laws. This includes the Broadcast Maestro name and logo, the design and layout of the app and website, the underlying software code, algorithms, databases, and any content we provide within the app (such as templates, text, or graphics created by us). Broadcast Maestro (or our licensors) retain all rights, title, and interest in and to these materials. We only grant you a limited, revocable license to use the Service for its intended purpose under these Terms. You may not: copy, modify, distribute, sell, or lease any part of our proprietary code or content; reverse engineer or attempt to extract the source code of the software (except to the extent such restrictions are expressly prohibited by law); or use the Broadcast Maestro trademarks without our prior written permission. All trademarks, logos, and service marks displayed on Broadcast Maestro are the property of their respective owners, and nothing in these Terms grants you any license or right to use them.

Permissible Use of the Service

We provide Broadcast Maestro to help you create and manage communication plans. You agree to use the Service only for lawful purposes and in accordance with these Terms. By using Broadcast Maestro, you agree NOT to:

Use the Service in any way that breaches any applicable law or regulation, or for any unlawful or fraudulent purpose.

Use the Service to transmit or store any harmful or malicious
content, including viruses, malware, or anything that could harm the Service or
other users’ devices.

Attempt to gain unauthorized access to the Service or its related systems or networks (for example, by hacking, password “mining,” or any other
illegitimate means).

Probe, scan, or test the vulnerability of any Broadcast Maestro system or network, or circumvent any security or authentication measures.

Misuse the Service’s communication features (if any) by sending unsolicited or unauthorized messages, advertising, or spam. Broadcast Maestro is
not an email platform – do not use it to spam anyone.

Impersonate any person or entity or falsely state your affiliation with a person or entity, or misrepresent the source of any content you upload.

Interfere with or disrupt the Service or servers (for example, launching a denial-of-service attack or excessively overloading resources in an automated
way).

Use any automated system (such as robots or scripts) to excessively call the API or scrape data from the Service in a manner that far exceeds a human’s use, without our prior permission.

Reverse engineer any aspect of Broadcast Maestro, or do anything that might discover source code or underlying trade secrets (except as allowed by non-excludable law).

Remove or obscure any proprietary notices on the Service (such as copyright or trademark symbols).

We reserve the right to suspend or terminate your access to Broadcast Maestro if we suspect any such prohibited conduct, or for any other behavior that we deem harmful to the Service or other users. (See Termination below for more information on account termination.)

Integrations and Third-Party Services

Broadcast Maestro may contain features that allow you to interface or integrate with third-party services (for example, maybe exporting a plan to a calendar app, or logging in via an identity provider). If you choose to use such features, you may be subject to additional terms and privacy policies of those third-party services. We do not control third-party services, and Broadcast Maestro is not responsible for the content or performance of third-party sites or services. For instance, if in the future Broadcast Maestro integrates with a third-party file storage service to attach files to plans, any such file stored on that third-party service would also be governed by that service’s terms. Please review any third-party terms before
enabling integrations.

Privacy

Your privacy is very important to us. Please review our Privacy Policy (above) to understand how we collect, use, and share your personal information when you use Broadcast Maestro . By using the Service, you acknowledge that we will process your data in accordance with our Privacy Policy. In particular, as an
enterprise-focused service, note that if your account is part of an organization, certain data (like your plans and usage) will be accessible by your organization’s admin. If you have any privacy-related questions, you can contact us as explained in the Privacy Policy. If you do not agree with our data practices, do not use the Service.

Subscription and Fees (if applicable)

Trials and Changes

Cancellation: Your organization’s admin may cancel a subscription at any time via the account settings or by contacting us. If a subscription is canceled, you will typically retain access to premium features until the end of the paid period, after which the account may be downgraded to a free plan (if available) or deactivated. Unless required by law or explicitly provided in a promotion, fees are non-refundable once paid. We will inform you of any specific refund policies that
might apply (for example, some jurisdictions have mandatory cooling-off periods
for online purchases – we will honor those as applicable).

Termination: You may stop using Broadcast Maestro at any time. If you wish to delete your account, you can do so either through the user settings (if available) or by contacting our support. Upon deletion, we will handle your data as described in the Privacy Policy (generally, content will be deleted or anonymized, with some data retained if necessary for legal reasons).

We reserve the right to suspend or terminate your access to the Service (or the access of any user in your organization) under the following circumstances:

Breach of Terms: If you violate any provision of these Terms or our policies, or if you engage in unlawful or improper use of Broadcast Maestro, we may suspend your account immediately and, if the issue is not resolved or is severe, terminate the account. For minor violations, we will attempt to provide a
warning and an opportunity to correct the issue, but we are not obligated to do so.

Non-Payment: If applicable fees are not paid on time, we reserve the right to suspend access to the paid features or the account. We will provide notice (e.g. an email reminder) of payment issues and a fair chance to rectify them before
terminating for non-payment.

Security or Maintenance: We might temporarily suspend accounts or the Service if needed to address security incidents, prevent unauthorized access, or perform maintenance. In such cases, we will restore access as soon as feasible.

Discontinuation of Service: In the unlikely event that we decide to discontinue the Broadcast Maestro Service entirely, we will give you as much advance notice as reasonably possible so that you can export your data. We would then terminate accounts when the service shuts down.

If your account or subscription is terminated for any reason: (a) these Terms will cease to apply to that account (except for provisions that are meant to survive termination, such as indemnification, disclaimers, limitation of liability, etc.), and
(b) you will lose access to your account and the data in it (so please ensure you have backups of your communication plans or export your data before termination,
if you need to retain it). We are not liable to you or any third party for termination of your account in accordance with these Terms.

Disclaimer of Warranties

Broadcast Maestro is provided on an “as is” and “as available” basis . While we strive to offer a high-quality and reliable service, we cannot promise that Broadcast Maestro will be perfect. To the fullest extent permitted by law, we disclaim all warranties and representations, express or implied, regarding the
Service. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement . We do not guarantee that Broadcast Maestro will meet all your requirements, that it will always be available, uninterrupted, secure, or error-free, or that the information it provides (such as any recommendations in a communication plan) is accurate or reliable. Any advice or information obtained from Broadcast Maestro (or its support channels) does not create any warranty not expressly stated in these Terms.

For example, Broadcast Maestro may help you generate a communication plan, but it’s ultimately up to you to review and implement that plan. We are not responsible if the plan does not achieve the results you intended. You acknowledge that using the Service is at your own risk. You also understand that we might in the future offer experimental or beta features – any such features will be used at your discretion and may have additional uncertainties.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above disclaimers may not apply to you. In such cases, our warranties are limited to the minimum scope permitted by applicable law.

Limitation of Liability: To the extent permitted by law, Broadcast Maestro and its affiliated companies, and our respective directors, officers, employees, agents, partners, and licensors, will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use
of (or inability to use) the Service . This includes, without limitation, damages for lost profits, lost revenue, lost business opportunities, loss of data, or business interruption. It also includes any loss or damage caused by bugs, viruses, or other technologically harmful material that may infect your devices due to your use of
our Service or any website or application linked to our Service.

In particular, we are not liable for: (i) your inability to access or use the Service at any time or for any period (for example, due to downtime, internet issues, or force majeure events); (ii) any unauthorized access to your account or content (for instance, if your credentials are compromised or if there is a security breach
despite our safeguards) ; or (iii) any modification, corruption, or loss of your content or data (we recommend keeping backup copies of important information outside the Service).

If, notwithstanding the above, we are found liable to you for any damage or loss arising out of or related to the Service, our total cumulative liability shall not exceed the amount you have paid to us for the Service in the six (6) months prior to the event giving rise to the liability, or €100 (one hundred Euros),

whichever is greater . If you use Broadcast Maestro on an unpaid basis, our total liability will be capped at €100. This limitation applies collectively to all claims, whether based on warranty, contract, statute, tort (including negligence), or any other legal theory, and whether or not Broadcast Maestro has been informed of the possibility of such damage.

Exceptions: We do not exclude or limit our liability to you where it would be illegal to do so. For example, this means we do not limit liability for death or personal injury caused by our gross negligence or willful misconduct, and we do not limit liability for our fraud. Additionally, because some jurisdictions do not allow certain
limitations of liability, the above may not apply to you in full. However, in such cases, our liability will be limited to the maximum extent permitted by law . Nothing in these Terms affects your statutory rights as a consumer that cannot be waived or limited by contract.

Indemnification (Your Liability to Us): You agree to indemnify and hold harmless Broadcast Maestro and its affiliates, and our respective directors, officers, employees, and agents from and against any and all third-party claims, liabilities, damages, losses, or expenses
(including reasonable legal fees) that arise out of or relate to: (a) your use of the Service, (b) your User Content or other data you submit, (c) your violation of these Terms, or (d) your violation of any law or the rights of a third party .

In plain language, if your actions cause us to be sued or incur costs (for example, you upload content you weren’t allowed to and someone claims infringement, or you misuse the app in a way that causes damage), you agree to cover our costs and losses. We will try to notify you promptly of any such claim and will allow you to participate in the defense (and we’ll cooperate with you at your expense). We
reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you (in which case, you agree to cooperate and provide any information and assistance we reasonably request).

Governing Law and Dispute Resolution

These Terms (and any disputes or claims arising out of or related to them or the Service) are governed by the laws of the Netherlands, without regard to its conflict of law principles . This means that the interpretation and enforcement of these Terms will be according to Dutch law.

If you are a consumer based in the European Union, you may also be entitled to
the protection of the mandatory consumer protection provisions of your country of residence, and nothing in these Terms will affect those rights . Essentially, if there are certain consumer rights or laws in your country that cannot be waived and are more beneficial to you than Dutch law, those may apply in your favor.

All disputes arising from or relating to these Terms or the use of the Service that cannot be resolved amicably between us shall be subject to the exclusive jurisdiction of the courts of the Netherlands . Unless another city is mandated by law, we suggest (and you agree) that the competent court in Amsterdam, Netherlands will be the venue for resolving any such disputes . By agreeing to these Terms, you consent to the jurisdiction of these courts.

However, we encourage you to contact us first to try to resolve any issue informally. We value our users, and disputes can often be resolved through our
support team without formal proceedings. If an amicable solution cannot be reached, then the above court jurisdiction will apply.

If you are a consumer in the EU, you also have the right to use the EU Online Dispute Resolution (ODR) platform to facilitate resolving disputes – but please note that we are not obligated to use any specific ADR (alternative dispute resolution) entity unless required by law.

Changes to These Terms

Broadcast Maestro may update or modify these Terms from time to time. If we make material changes, we will notify you by, for example, sending an email to the address associated with your account or by posting a prominent notice within the Service. Updated Terms will be posted on our website with a new “Last updated” date. Please review any changes carefully. If you continue to use Broadcast Maestro after the new Terms have become effective, you will be considered to have accepted the updated Terms. If you do not agree to the changes, you should stop using the Service and, if necessary, cancel your account before the new Terms take effect.

For changes that are minor or editorial (for example, correcting a typo or clarifying a clause) and do not materially affect your rights, we may not send a formal notice, so it’s a good idea to check this page periodically. We will always note the effective date of the latest version at the top

Miscellaneous

Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Broadcast Maestro regarding the Service, and supersede any prior agreements or understandings (whether written or oral) relating to the same subject matter.

Severability: If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible and the remaining provisions of these Terms will remain in full force and effect.

No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver must be in writing and signed by an authorized representative of Broadcast Maestro.

Assignment: You may not assign or transfer your rights or obligations under these Terms to anyone else without our prior written consent. We may assign our rights and obligations to an affiliate or in connection with a merger, acquisition, or sale of assets, or by operation of law or otherwise. These Terms will bind and inure to the benefit of the parties, their successors, and permitted assigns.

No Agency: Nothing in these Terms creates any agency, partnership, or joint venture between you and Broadcast Maestro. You and Broadcast Maestro are independent contractors.

Third-Party Beneficiaries: There are no third-party beneficiaries to these Terms; the agreement is between you and Broadcast Maestro only.
